I think it’s reasonable to argue that your choice of how you pursue happiness is declared in the Declaration as an inalienable right granted not by the state but by the Creator. State marriage licensing either denies that principle or claims to have the power to overrule the principles of Natural Law that are embedded in the Declaration and codified by the Constitution. In other words, marriage licensing by the state should be declared unConstitutional. Marriage could be simply by a mutual contract of marriage filed with the state just like many legal transactions. There is no need for the state to grant permission to enter into a marriage contract between consenting individuals of legal age and witnessed. We could have peace and get along and maybe retain some civility and sanity in America.
